Mr. Chairman,

1. I have the honor to speak on behalf of the Group of 77 and China on agenda item 148: Financing of the International Residual Mechanism for Criminal Tribunals, in particular the construction of a new facility for the International Residual Mechanism for Criminal Tribunals, Arusha branch.

2. At the outset, the Group would like to thank Mr. Olufemi Elias, Assistant Secretary-General, Registrar of the Mechanism for International Criminal Tribunals, as well as Mr. Carlos Ruiz Massieu, Chair of the Advisory Committee for Administrative and Budgetary Questions,for presenting their respective reports on this agenda item.

3. The Group welcomes the substantial completion of the construction of the facility in Arusha and notes that the facility is fully operational and occupied by the Mechanism since 5 December 2016.

4. The Group would like to reiterate its appreciation to the Government of the United Republic of Tanzania for its continued support to the project as well as to the work of the Tribunal and Mechanism. We encourage the Secretary-General to ensure the continued cooperation between the Organization and all stakeholders in the post-occupancy phase of the project.

5. The Group notes that the project has remained within the overall approved budget, however, the projected savings have been reduced due to project delays. The Group will seek further information during the informal consultations on the project delays; the direct and indirect costs thereof; and the potential recovery of such costs using contractual remedies. The Group trusts that the defect and liability phase will be completed within the projected timeline and without any further costs to the Organisation.

6. With regards to governance and oversight of the project, the Group takes note of the information presented and we look forward to receiving updates on OIOS oversight coverage related to the project as well as plans for the audit of the post-construction phase.

7. The Group notes that other international organisations and judicial institutions are expected to move to the vicinity of the Facility. The Group urges the Mechanism to share its lessons learned in the construction of the Facility and to engage in discussions with these organisations to create synergies and ensure efficiencies where possible.

8. In conclusion, the Group of G77 and China would like to assure you of its readiness to engage constructively in the upcoming discussions with the aim of concluding this important agenda item in a timely fashion.

DECLARACIÓN A NOMBRE DEL GRUPO DE LOS 77 Y CHINA, POR EL SEGUNDO SECRETARIO JONATHAN VIERA, MISIÓN PERMANENTE DEL ECUADOR, SOBRE EL TEMA DE AGENDA 148: FINANCIACIÓN DEL MECANISMO RESIDUAL INTERNACIONAL DE LOS TRIBUNALES PENALES - CONSTRUCCIÓN DE NUEVOS LOCALES PARA EL MECANISMO RESIDUAL INTERNACIONAL DE LOS TRIBUNALES PENALES, SUBDIVISIÓN DE ARUSHA, EN EL PRIMERA PARTE DE LA 71A SESIÓN REANUDADA DE LA QUINTA COMISIÓN DE LA ASAMBLEA GENERAL DE LAS NACIONES UNIDAS (Nueva York, 8 de marzo de 2017)

Señor Presidente,

1. Tengo el honor de hablar en nombre del Grupo de los 77 y China sobre el tema 148 del programa: Financiacio?n del Mecanismo Residual Internacional de los Tribunales Penales, en particular la construccio?n de nuevos locales para el Mecanismo Residual Internacional de los Tribunales Penales, subdivisio?n de Arusha

2. Primeramente, el Grupo desea agradecer al Sr. Olufemi Elias, Subsecretario General, Secretario del Mecanismo para los Tribunales Penales Internacionales, así como al Sr. Carlos Ruiz Massieu, Presidente de la Comisión Consultiva para Asuntos Administrativos y de Presupuesto, por presentar sus respectivos informes sobre este punto del orden del día.

3. El Grupo acoge con beneplacito la conclusión sustancial de la construcción de la instalación en Arusha y nota que la instalación está plenamente operativa y ocupada por el Mecanismo desde el 5 de diciembre de 2016.

4. El Grupo desea reiterar su reconocimiento al Gobierno de la República Unida de Tanzanía por su constante apoyo al proyecto, así como a la labor del Tribunal y el Mecanismo. Alentamos al Secretario General a que garantice la cooperación continua entre la Organización y todas las partes interesadas en la fase posterior a la ocupación del proyecto.

5. El Grupo nota que el proyecto se ha mantenido dentro del presupuesto general aprobado, sin embargo, los ahorros proyectados se han reducido debido a los retrasos en los proyectos. El Grupo solicitará más información durante las consultas oficiosas sobre los retrasos en los proyectos; los costos directos e indirectos de los mismos y la posible recuperación de esos costos utilizando recursos contractuales. El Grupo confía en que la fase de defectos y responsabilidad se completará dentro del plazo proyectado y sin ningún costo adicional para la Organización.

6. En lo referente a la gobernanza y la supervisión del proyecto, el Grupo toma nota de la información presentada y esperamos recibir actualizaciones sobre la cobertura de supervisión de la OSSI relacionada con el proyecto, así como planes para la auditoría de la fase posterior a la construcción.

7. El Grupo nota que se espera que otras organizaciones internacionales e instituciones judiciales se trasladen a las inmediaciones de la Facilidad. El Grupo exhorta al Mecanismo a que comparta sus lecciones aprendidas en la construcción del Mecanismo ya entablar conversaciones con estas organizaciones para crear sinergias y garantizar la eficacia en la medida de lo posible.

8. En conclusión, el Grupo de los 77 y China desea asegurarle que está dispuesto a comprometerse de manera constructiva en los próximos debates con el fin de concluir oportunamente este importante punto del orden del día.
