STATEMENT ON BEHALF OF THE GROUP OF 77 AND CHINA BY MS. LOURDES PEREIRA SOTOMAYOR, FIRST SECRETARY OF THE PERMANENT MISSION OF THE REPUBLIC OF ECUADOR TO THE UNITED NATIONS, ON AGENDA ITEM 149: ADMINISTRATIVE AND BUDGETARY ASPECTS OF THE FINANCING OF THE UNITED NATIONS PEACEKEEPING OPERATIONS: CROSS-CUTTING ISSUES, AT THE SECOND RESUMED PART OF THE SEVENTY-FIRST SESSION OF THE FIFTH COMMITTEE OF THE UNITED NATIONS GENERAL ASSEMBLY (New York, 8 May 2017)

Mr. Vice-Chair,

1. I have the honor to speak on behalf of the Group of 77 and China on agenda item 149, Administrative and budgetary aspects of financing United Nations peacekeeping operations, particularly on cross-cutting issues.

2. The Group would like to thank Ms. Heidi Mendoza, Under-Secretary-General for Internal Oversight Services, Ms. Lisa Buttenheim, Assistant Secretary-General for Field Support, and Ms. Jane Holl Lute, Special Coordinator on improving the United Nations' response to sexual exploitation and abuse, for introducing the various reports on this agenda. The Group would also like to thank Mr. Carlos Ruiz Massieu, the Chair of the ACABQ, for the related reports of the Advisory Committee.

3. The Working Group on Contingent-Owned Equipment met in January 2017 with 76 Member States to discuss the critical issue of bridging the gap between the mandates of peacekeeping missions and the capabilities available to implement them.

4. The recommendations issued by the COE Working Group in report A/71/802 will improve conditions in a number of areas, for the benefit of the uniformed men and women serving under the United Nations flag.

5. Some important issues were left unresolved, such as that of armored personal carriers, but the Group of 77 and China recognizes that the final report of the Working Group was the result of extensive, drawn-out negotiations at the level of military advisers. We therefore welcome the consensus achieved by the COE Working Group and fully support the recommendations contained in its report.

6. Turning to the report of the Office of Internal Oversight Services (OIOS), the Group notes that a total of 249 oversight reports were issued. The Group is pleased to note that the 528 recommendations developed enjoyed widespread acceptance by relevant departments. The Group also notes that in 2016, the Office registered an increase of 226% in the number of cases opened during the year compared with 2015. Many cases were also closed during the year. It is noted that the higher number of investigations and contingent reports related to sexual exploitation and abuse. We take this opportunity to recognize the hard work of the OIOS, under the leadership of Under-Secretary-General Heidi Mendoza.

7. The Group notes that a high number of investigations remain pending, and expects that the Office will undertake to expedite conclusion of pending cases without further delay. We trust that the office will continue to closely monitor the implementation of its recommendations. The Group also notes that the Office has developed a work plan based on a comprehensive risk-based assessment, and developed in close consultation with other key stakeholders. We encourage the Office to continue its efforts to improve the effectiveness and efficiency of its work, as well as its close collaboration with other agencies and departments.

8. On the issue of sexual exploitation and abuse, the Group reaffirms its strong commitment to the United Nations' zero-tolerance policy towards sexual exploitation and abuse. Zero-tolerance must apply equally to all, whether they are uniformed personnel or civilians, and regardless of the color of their helmet.

9. In this regard, the Group welcomes the strong resolve of the Secretary-General towards ensuring that the Organization will not remain silent or passive in the face of reported incidents, as well as towards protecting and supporting victims of SEA through adopting a victim- centered approaching addressing this problem, and putting in place effective preventive policies that address the root causes of this plague.

10. The Group also takes this opportunity to thank and acknowledge the central role of Ms Jane Holl Lute as Special Coordinator on Improving the United Nations' Response to Sexual Exploitation and Abuse, and her contributions towards a more unified, system-wide approach to SEA. The Group notes her efforts to address the issue of system-wide coherence, and the work that has been done to increase engagement with Member States, identify root causes and risk factors, analyze gaps and weaknesses in current structures, and share best practices.

11. Further, the Group commends measures taken by numerous TCCs and PCCs to address different aspects of the problem of SEA and encourages the Secretariat to facilitate cooperation among these countries on best practices as well as a greater role for the UN in enhancing national capacities and learning in this regard.

12. At the broader level, the Group of 77 and China believe that we must approach the issue of sexual exploitation and abuse in a collective and holistic manner. All stakeholders have a part to play, and responsibilities to assume. Only by working together can we move forward together. An effective Triangular cooperation mechanism could be an option to deal with this menace.

13. In this regard, the Group will participate actively and constructively in the Committee's deliberations on this important topic. In particular, we will be interested to learn what steps have been taken, and what steps the Secretary-General intends to take, to improve investigation mechanisms, and ensure a culture of accountability takes root across the system, for all who march or work under the United Nations' flag.

14. The Group would also like to seek further information on mechanisms utilized by the Secretariat when dealing with SEA cases involving civilians and UN personnel both at the secretariat and in the field. We would like to better understand the mechanisms, or the lack thereof, of how the United Nations deals with its staff that is found guilty of sexual exploitation and abuse.

15. With respect to reporting, the Group recalls that that the General Assembly took a historic step forward last year during the second resumed session of its seventieth session to adopt new measures in the reporting of allegations of sexual exploitation and abuse. With these new measures, Member States demonstrated their resolve to ensuring full transparency in reporting cases of SEA, with no distinction between UN and non-UN troops. However, the Group notes that reporting on SEA regarding preventive, enforcement, and remedial actions necessary to address and prevent incidents of SEA still lacks coordination. The Group notes that clear information on the overall scope of and linkages between different reports and databases on SEA is not available. The Group therefore emphasizes the need for improved collaboration across the system, in order to provide all stakeholders with comprehensive information in a timely manner that can contribute to better coordination in the Organization's response.

16. The Group takes note of the proposal of the Secretary-General contained in document A/71/818 to establish the office of the victims' rights advocate and the Office of the Special Coordinator as well as 12 positions related thereto. We will carefully examine during informal consultations how these proposals can contribute to efforts to achieve our shared objectives of formulating a comprehensive framework to respond to the serious problem of SEA and to end impunity for those proven guilty thereof.

17. The Group of 77 and China stand ready to work constructively with all parties to ensure that we make a difference to the most vulnerable, and continue to uphold the name, reputation, credibility, and integrity of the United Nations.

Señor Vicepresidente,

1. Tengo el honor de hablar en nombre del Grupo de los 77 y China sobre el tema 149 del programa, Aspectos administrativos y presupuestarios de la financiación de las operaciones de mantenimiento de la paz de las Naciones Unidas, en particular sobre cuestiones intersectoriales.

2. El Grupo agradece a la señoras Heidi Mendoza, Secretaria General Adjunta de Servicios de Supervisión Interna, Lisa Buttenheim, Subsecretaria General de Apoyo a las Actividades sobre el Terreno, y Jane Holl Lute, Coordinadora Especial para mejorar la respuesta de las Naciones Unidas a la explotación y el abuso sexuales, por la presentación de los diversos informes sobre este programa. El Grupo también desea agradecer al Sr. Carlos Ruiz Massieu, Presidente de la Comisión Consultiva, por los informes correspondientes de esta Comisión.

3. El Grupo de Trabajo sobre Equipos de Propiedad de los Contingente se reunió en enero de 2017 con 76 Estados Miembros para discutir la cuestión crítica de cerrar la brecha entre los mandatos de las misiones de mantenimiento de la paz y las capacidades disponibles para implementarlas (ponerlas en práctica)
4. Las recomendaciones emitidas por el Grupo de Trabajo del COE en el informe A / 71/802 mejorarán las condiciones en un número de áreas, en beneficio de los hombres y mujeres uniformados que sirven bajo la bandera de las Naciones Unidas.

5. Algunas cuestiones importantes quedaron sin resolver, como la de los vehículos blindados de transporte de personas, pero el Grupo de los 77 y China reconoce que el informe final del Grupo de Trabajo fue el resultado de amplias y prolongadas negociaciones a nivel de asesores militares. Por lo tanto, acogemos con beneplácito el consenso logrado por el Grupo de Trabajo del COE y apoyamos plenamente las recomendaciones que figuran en su informe.

6. En relación con el informe sobre las actividades de la Oficina de Servicios de Supervisión Interna (OSSI), el Grupo observa que se han publicado 249 informes de supervisión. El Grupo se complace en señalar que las 528 recomendaciones elaboradas gozan de una amplia aceptación por parte de los departamentos pertinentes. El Grupo señala asimismo que en el año 2016 la Oficina registró un incremento del 226% en el número de casos abiertos durante el año en comparación con 2015. Muchos casos también se cerraron durante el año 2016. Se observa que el mayor número de informes de investigaciones y relativos a contingentes correspondió a casos de explotación y el abuso sexual. Aprovechamos esta oportunidad para reconocer el arduo trabajo de la OSSI, bajo la dirección de la Subsecretaria General Heidi Mendoza.

7. El Grupo observa que sigue pendiente un elevado número de investigaciones y espera que la Oficina se comprometa a acelerar la conclusión de los casos pendientes sin más demora. Confiamos en que la oficina continuará supervisando de cerca la aplicación de sus recomendaciones. El Grupo también observa que la Oficina ha elaborado un plan de trabajo sobre la base de en una evaluación exhaustiva de los riesgos y elaborado en estrecha consulta con los partes interesadas. Alentamos a la Oficina a que prosiga sus esfuerzos para mejorar la eficacia y la eficiencia de su labor, así como su estrecha colaboración con otros organismos y departamentos.

8. En cuanto a la cuestión de la explotación y los abusos sexuales, el Grupo reafirma su firme compromiso con la política de tolerancia cero de las Naciones Unidas contra la explotación y los abusos sexuales. La tolerancia cero debe aplicarse igualmente a todos, ya sea personal uniformado o civiles, e independientemente del color de su casco.

9. A este respecto, el Grupo acoge con satisfacción la firme determinación del Secretario General de velar por que la Organización no permanezca callada ni pasiva frente a los incidentes denunciados, así como a proteger y apoyar a las víctimas de la SAE mediante la adopción de un enfoque centrado en las víctimas Abordar este problema y establecer políticas preventivas eficaces que aborden las causas profundas de esta plaga.

10. El Grupo también aprovecha esta oportunidad para agradecer y reconocer el papel central de la Sra. Jane Holl Lute como Coordinadora Especial para Mejorar la Respuesta de las Naciones Unidas a la Explotación y el Abuso Sexual y sus contribuciones a un enfoque más unificado y en todo el sistema de la Organización. El Grupo toma nota de sus esfuerzos para abordar la cuestión de la coherencia en todo el sistema y el trabajo que se ha realizado para aumentar el compromiso con los Estados Miembros, identificar las causas fundamentales y los factores de riesgo, analizar las brechas y debilidades de las estructuras actuales y compartir las mejores prácticas.

11. Además, el Grupo encomia las medidas adoptadas por numerosos países que aportan contingentes y fuerzas de policía para abordar diferentes aspectos del problema de la SAE y alienta a la Secretaría a facilitar la cooperación entre estos países sobre las mejores prácticas y mayor rol de las Naciones Unidas en la mejora de las capacidades nacionales y el aprendizaje en este sentido.

12. En el plano más amplio, el Grupo de los 77 y China creemos que debemos abordar la cuestión de la explotación y el abuso sexuales de manera colectiva y holística. Todas las partes interesadas tienen un papel que desempeñar y responsabilidades que deben asumir. Solamente trabajando juntos podemos avanzar juntos. Un mecanismo de cooperación triangular eficaz podría ser una opción para hacer frente a esta amenaza.

13. A este respecto, el Grupo participará activa y constructivamente en las deliberaciones del Comité sobre este importante tema. En particular, estaremos interesados en conocer las medidas que se han adoptado y qué medidas se propone adoptar el Secretario General para mejorar los mecanismos de investigaciones y asegurar que una cultura de rendición de cuentas se arraigue en todo el sistema para todos los que marchan o trabajan bajo la bandera de las Naciones Unidas.

14. El Grupo también desea obtener más información sobre los mecanismos utilizados por la Secretaría cuando se trata de casos de explotación y los abusos sexuales que involucran a civiles y personal de la ONU tanto en la secretaría como sobre el terreno. Nos gustaría entender mejor los mecanismos o la falta de los mismos, de cómo las Naciones Unidas se ocupa o aborda los casos de su personal que se encuentra culpable de explotación y de los abusos sexuales.

15. En lo que respecta a la presentación de informes, el Grupo recuerda que la Asamblea General dio un paso histórico el año pasado durante la segunda reanudación de su 70º período de sesiones para adoptar nuevas medidas en la denuncia de denuncias de explotación y abuso sexuales. Con estas nuevas medidas, los Estados Miembros demostraron su determinación de garantizar la plena transparencia en la notificación de casos de SAE, sin distinción entre las tropas de las Naciones Unidas y las que no son de la ONU. Sin embargo, el Grupo observa que los informes sobre la SAE relativos a las medidas preventivas, coercitivas y correctivas necesarias para abordar y prevenir los incidentes de SAE siguen careciendo de coordinación. El Grupo observa que no se dispone de información clara sobre el alcance general y los vínculos entre distintos informes y bases de datos sobre la SAE. Por consiguiente, el Grupo hace hincapié en la necesidad de mejorar la colaboración en todo el sistema, a fin de proporcionar a todas las partes interesadas información completa y oportuna que pueda contribuir a mejorar la coordinación en la respuesta de la Organización.

16. El Grupo toma nota de la propuesta del Secretario General contenida en el documento A / 71/818 de establecer la oficina del defensor de los derechos de las víctimas y la Oficina del Coordinador Especial, así como 12 puestos conexos. Examinaremos cuidadosamente durante las consultas informales cómo estas propuestas pueden contribuir a lograr nuestros objetivos comunes de formular un marco amplio para responder al grave problema de la SAE y poner fin a la impunidad de los culpables.

17. El Grupo de los 77 y China están dispuestos a trabajar de manera constructiva con todas las partes para que hagamos la diferencia a los más vulnerables y mantengamos el nombre, la reputación, la credibilidad y la integridad de las Naciones Unidas.

18. En conclusión, el Grupo también desea asegurarle nuestro compromiso constructivo sobre estas cuestiones en las deliberaciones conexas durante las consultas oficiosas.
