Mr. Chair,

I have the honor to deliver this statement on behalf of the Group 77 and China.

At the outset, I recognize the presence of His Excellency Mr. Jorge Faurie, Minister of Foreign Affairs and Worship of the Republic of Argentina, who has given a detailed presentation on the issue under our consideration in this meeting. I commend the efforts of the Special Committee on Decolonization, which this year is chaired by the Bolivarian Republic of Venezuela, in pursuance of the historic mandate to eradicate colonialism in all regions of the world.

The Ministers for Foreign Affairs of the States members of the Group of 77 and China met at Headquarters in New York on 23 September 2016 on the occasion of their fortieth annual meeting. The Ministers reviewed the world economic situation; the recent developments in the world and the particular challenges faced by developing countries in the economic, social and environmental areas. In this meeting, the Ministers adopted a Declaration in which they reaffirmed:

"the need for the Governments of the Argentine Republic and the United Kingdom to resume negotiations in accordance with the principles and the objectives of the Charter and the relevant resolutions of the Assembly in order to find, as soon as possible, a peaceful solution to the sovereignty dispute relating to the question of the Malvinas Islands, which seriously damages the economic capacities of the Argentine Republic and the need for both parties to refrain from taking decisions that would imply introducing unilateral modifications in the situation while the islands are going through the process recommended by the Assembly."

"Highlighting the right of the States members of the Group of 77 to permanent sovereignty over their energy resources, the Ministers expressed the view that the operations not authorized by the Government of Argentina in the Malvinas Islands area relating to the exploration of natural resources, especially hydrocarbon resources, were seriously detrimental to the sovereignty rights of the Argentine Republic over its continental shelf. The Ministers recognized the right of the Argentine Republic to take legal action with full respect for international law and relevant resolutions against non- authorized hydrocarbon exploration and exploitation activities in the referred area."

DECLARACIÓN EN NOMBRE DEL GRUPO DE LOS 77 Y CHINA POR S.E. EMBAJADOR HORACIO SEVILLA BORJA, REPRESENTANTE PERMANENTE DE LA REPÚBLICA DEL ECUADOR ANTE LAS NACIONES UNIDAS SOBRE LA CUESTIÓN DE LAS ISLAS MALVINAS EN EL MARCO DE LA SESIÓN DE 2017 DEL COMITÉ ESPECIAL SOBRE LA SITUACIÓN EN RELACIÓN CON LA IMPLEMENTACIÓN DE LA DECLARACIÓN SOBRE LA CONCESIÓN DE LA INDEPENDENCIA A LOS PAÍSES Y PUEBLOS COLONIALES (NUEVA YORK, 23 DE JUNIO DE 2017)

Sr. Presidente,

Tengo el honor de pronunciar esta intervención en nombre del Grupo de los 77 y China.

Ante todo, saludo la presencia de Su Excelencia el Sr. Jorge Faurie, Ministro de Relaciones Exteriores y Culto de la República Argentina, quien ha realizado una detallada presentación sobre el tema sometido a nuestra consideración en esta reunión. Elogio los esfuerzos del Comité Especial de Descolonización, que este año es presidido por la República Bolivariana de Venezuela, en búsqueda del histórico mandato de erradicar el colonialismo en todas las regiones del mundo.

Los Ministros de Relaciones Exteriores de los Estados Miembros del Grupo de los 77 y China se reunieron en la Sede de las Naciones Unidas en Nueva York el 23 de septiembre de 2016 con ocasión de su cuadragésima reunión anual. Los Ministros examinaron la situación económica mundial, los acontecimientos ocurridos recientemente en el mundo y los problemas especiales a los que se enfrentan los países en desarrollo en las esferas económica, social y medioambiental. En esta reunión, los Ministros adoptaron una Declaración en la que reafirmaron:

"la necesidad de que los Gobiernos de la República Argentina y del Reino Unido de Gran Bretaña e Irlanda del Norte reanuden sus negociaciones de conformidad con los principios y los objetivos de la Carta de las Naciones Unidas y las resoluciones pertinentes de la Asamblea, a fin de encontrar lo antes posible una solución pacífica a la disputa de soberanía relacionada con la cuestión de las Islas Malvinas, que perjudica gravemente a la capacidad económica de la República Argentina, y la necesidad de que ambas partes se abstengan de tomar decisiones que entrañen la introducción de modificaciones unilaterales de la situación mientras las islas se encuentren en medio del proceso recomendado por la Asamblea.

Poniendo de relieve el derecho de los Estados Miembros del Grupo de los 77 a la soberanía permanente sobre sus recursos energéticos, los Ministros expresaron el criterio que las operaciones de exploración de los recursos naturales, especialmente los recursos de hidrocarburos, realizadas por empresas no autorizadas por el Gobierno de la Argentina en la zona de las Islas Malvinas son gravemente perjudiciales para los derechos de soberanía de la República Argentina sobre su plataforma continental.

Los Ministros reconocieron el derecho de la República Argentina a emprender acciones judiciales, con pleno respeto del derecho internacional y las resoluciones pertinentes, contra las actividades no autorizadas de exploración y explotación de hidrocarburos en la zona mencionada."
