Mr. Chair,

1. I have the honour to speak on behalf of the Group of 77 and China on agenda item 136: Proposed Programme Budget for Biennium 2018-2019,with particular reference to the use of the Commitment authority and the request for a subvention to the Residual Special Court for Sierra Leone (RSCSL).

2. At the outset the Group of 77 and China would like to thank Mr. Johannes Huisman, Director, Programme Planning and Budget Division, Office of Programme Planning, Budget and Accounts for introducing the report of the Secretary-General contained in document A/72/384 and Mr. Babou Sene, Vice-Chairman of the Advisory Committee on Administrative and Budgetary Questions, for introducing the related report contained in document A/72/7/Add.20 on this agenda item.

3. The Group of 77 and China would like to reiterate its commitment to the smooth functioning of the mandated judicial institutions including the Residual Special Court for Sierra Leone. In this regard consideration of the administrative and financial aspects of the RSCSL remains one of the important items on the Group's agenda.

4. The Group of 77 and China recalls that by its resolution 71/272 of 23rd December 2016, the General assembly authorized the Secretary General to enter into commitment in an amount not to exceed $2.8 million, to supplement the voluntary financial resources of the RSCSL for the period, 1st January to 31st December 2017. The Group has also taken note of both the details provided by the Secretary-General on the use of the approved commitment authority and the current financial status of the Court.

5. On fundraising activities, the Group of 77 and China has taken note with serious concern that despite the intensive fundraising endeavors by the Secretary-General, the Oversight Committee and the principal officials of the Court there is no prospect of future voluntary contributions. We therefore remain concerned the lack of sustainable funding may negatively affect the Court in the delivery of its important mandate.

Considering the unpredictable nature of voluntary contribution as a funding mechanism for the Court and mindful of the fact that subvention is only a temporary measure, the Group of 77 and China would like to reiterate the need for a long term sustainable funding mechanism for the Court, preferably, through assessment from Member States.

7. The Group is also prepared to closely examine the details of other elements of the report including but not limited to staffing, logistical support, and administrative arrangements during our informal consultations.

8. In conclusion, the Group would like to assure you of our readiness to engage constructively in the consideration of this agenda item with a view to reaching conclusion in a timely manner.

DECLARACIÓN EN NOMBRE DEL GRUPO DE LOS 77 Y CHINA POR LOURDES PEREIRA SOTOMAYOR, PRIMER SECRETARIO, MISIÓN PERMANENTE DEL ECUADOR ANTE LAS NACIONES UNIDAS, SOBRE EL TEMA 136 DEL PROGRAMA: PROYECTO DE PRESUPUESTO POR PROGRAMAS PARA EL BIENIO 2018-2019: SOLICITUD DE SUBVENCIÓN PARA EL TRIBUNAL ESPECIAL RESIDUAL PARA SIERRA LEONA, EN LA PARTE PRINCIPAL DEL SEPTUAGÉSIMO SEGUNDO PERIODO DE SESIONES DE LA ASAMBLEA GENERAL DE LAS NACIONES UNIDAS, QUINTA COMISIÓN (Nueva York, 13 de noviembre de 2017)

Sr. Presidente,

1. Tengo el honor de hablar en nombre del Grupo de los 77 y China sobre el tema 136 del programa: Proyecto de presupuesto por programas para el bienio 2018-2019, con particular referencia al uso de la autorización para contraer compromisos de gastos y la solicitud de una subvención para el Tribunal Especial Residual para Sierra Leona (RSCSL).

2. Para iniciar, el Grupo de los 77 y China desea dar las gracias al Sr. Johannes Huisman, Director de la División de Planificación de Programas y Presupuesto de la Oficina de Planificación de Programas, Presupuesto y Cuentas por presentar el informe del Secretario General que figura en el documento A/72/384 y al Sr. Babou Sene, Vicepresidente de la Comisión Consultiva en Asuntos Administrativos y de Presupuesto, por presentar el informe conexo que figura en el documento A 72/7/Add.20 sobre este tema del programa.

3. El Grupo de los 77 y China desea reiterar su compromiso con el buen funcionamiento de las instituciones con mandato judicial, incluido el Tribunal Especial Residual para Sierra Leona. En este sentido, la consideración de los aspectos administrativos y financieros del RSCSL sigue siendo uno de los puntos importantes en la agenda del Grupo.

4. El Grupo de los 77 y China recuerda que en su resolución 71/272 de 23 de diciembre de 2016, la Asamblea General autorizó al Secretario General a comprometerse por un monto no superior a $ 2,8 millones, para complementar los recursos financieros voluntarios del RSCSL para el período comprendido entre el 1 de enero y el 31 de diciembre de 2017. El Grupo también tomó nota de los detalles proporcionados por el Secretario General sobre el uso de la autorización para contraer compromisos de gastos aprobada y el estado financiero actual del Tribunal.

5. En cuanto a las actividades de recaudación de fondos, el Grupo de los 77 y China ha tomado nota con gran preocupación de que, a pesar de los intensos esfuerzos de recaudación de fondos del Secretario General, el Comité de Supervisión y los principales funcionarios del Tribunal, no hay perspectivas de contribuciones voluntarias futuras. Por lo tanto, seguimos preocupados de que la falta de financiación sostenible pueda afectar negativamente al Tribunal en el cumplimiento de su importante mandato.

Considerando la naturaleza impredecible de la contribución voluntaria como mecanismo de financiación para el Tribunal y teniendo en cuenta que la subvención es solo una medida temporal, el Grupo de los 77 y China desea reiterar la necesidad de un mecanismo de financiación sostenible a largo plazo para el Tribunal, de preferencia, mediante contribuciones por parte de los Estados miembros.

7. El Grupo también está preparado para examinar de cerca los detalles de otros elementos del informe, inclusive, pero no limitados a la dotación de personal, el apoyo logístico y los arreglos administrativos durante nuestras consultas informales.

8. En conclusión, el Grupo desea asegurarle que estamos dispuestos a participar constructivamente en el examen de este tema del programa, con miras a llegar a una conclusión de manera oportuna.
