FUAD BATEH, SENIOR ADVISOR, MISSION OF THE STATE OF PALESTINE TO THE UNITED NATIONS, ON AGENDA ITEM 7: CAPACITY-BUILDING AND THE TRANSFER OF MARINE TECHNOLOGY, AT THE SECOND SESSION OF THE INTERGOVERNMENTAL CONFERENCE ON AN INTERNATIONAL LEGALLY BINDING INSTRUMENT UNDER THE UNITED NATIONS CONVENTION ON THE LAW OF THE SEA ON THE CONSERVATION AND SUSTAINABLE USE OF MARINE BIOLOGICAL DIVERSITY OF AREAS BEYOND NATIONAL JURISDICTION (New York, 2-3 April 2019)

6. Capacity-building and the transfer of marine technology

Thank you very much Madam Facilitator. On behalf of the G77 & China with regard to section 6.2 entitled "Types of and modalities for capacity-building and transfer of marine technology" under the first theme of Types, the Group believes that we could eliminate Option III "No text". And, with regard to Option I and Option II, we believe there is some balance to be had as Option I could benefit from some streamlining with the opportunity for future development as provided in the concepts within Option II.

With regard to the theme of Modalities, the Group can work on the basis of Option II. Referring to some of the numbered paragraphs under Option II, on paragraph (1) we see some combination of the sub-options. In paragraph (2), we see some formulation of Option C although we might see some element of Option B in relation to needs assessments at the regional level. In regard to paragraph (6), the Group sees a formulation of Option A with some combination of the sub-options, and we consider the use of "equitable" more appropriate language where we the current text uses "reasonable".

With regard to the theme of Clearing-house mechanisms, the Group believe can work on the basis of Option II.

Thank you very much Madam Facilitator. With regard to section 6.3 entitled "Funding", the Group of 77 & China would eliminate Option II "No text". The Group would favour Option A within paragraph (2) under Option I. In paragraph (4), the Group would eliminate Option C "No text", and go further in wanting to see some formulation combining Option B and also Option A reminding that the voluntary trust fund allows the participation of representatives of many developing countries to meetings such as this one. Further still, there are certain clarifications in Option B that members of the Group hope will be more clear following discussions on this section and the Second Session of the IGC as a whole. With regard to section 6.4 "Monitoring and review", the Group of 77 & China would eliminate OPTION II "No text", and therefore see some formulation of Option I.

With regard to paragraph (4), the Group would envision some combination from among the available sub-options. Thank you very much.

Thank you once again Madam Facilitator. With regard to section 6 entitled "Capacity-building and the transfer of marine technology", the G77 & China would be in favor of eliminating Option II "No text", and moving forward with some formulation of Option I.

With regard to section 6. 1 entitled "Objectives of capacity-building and the transfer of marine technology", under the first theme of General Objectives and Principles, the Group of 77 & China would like to see some formulation of Option 1 with the inclusion of some of the element of Option 2.

With regard to the theme of "Specific objectives", the Group would like to eliminate Option III "No text".

With regard to the theme of "Categories of States and special requirements of developing countries", the Group of 77 & China would favor some formulation of Option I under paragraph (2). Thank you very much.
